Agreement to These Terms
These Terms and Conditions ("Terms") govern your access to and use of the TaxiNaija mobile application, the website taxinaija.com, and related services (the "Services") provided by TaxiNaija Technologies LTD (RC 9320671), a company registered in Nigeria, with an affiliate in the United States (TaxiNaija Technologies LLC, Wyoming).
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy and Refund Policy, which form part of these Terms. If you do not agree, do not use the Services.
About the Services
TaxiNaija is a technology platform that connects riders seeking transportation with independent drivers offering transportation services in Nigeria. Unless expressly stated otherwise, TaxiNaija does not itself provide transportation services; drivers are independent providers responsible for the trips they accept.
Eligibility and Accounts
- You must be at least 18 years old and capable of entering a binding contract.
- You must register with accurate, current information and keep it up to date. Identity verification may be required, and we may suspend accounts that fail verification.
- You are responsible for all activity on your account and for keeping your login credentials and device secure.
- One account per person. Accounts are not transferable.
Driver Terms
- Drivers must hold a valid Nigerian driver's licence, vehicle registration, insurance, and any permits required by federal, state, or local law.
- Drivers must pass TaxiNaija's onboarding and screening checks and keep their documents current.
- Drivers are independent contractors, not employees, agents, or partners of TaxiNaija.
- Drivers agree to maintain their vehicles in a safe, roadworthy condition and to comply with all traffic laws.
Fares and Payments
- Fares are calculated based on distance, time, and applicable rates displayed in the app before or at the time of booking. Additional charges (tolls, waiting time, overtime charges for trips exceeding estimated duration, cancellation fees) may apply where disclosed in the app.
- Payments are processed by our licensed third-party payment processor, Flutterwave. By paying through the app you also agree to the processor's terms. We do not store your full card details.
- You authorise us (through our processor) to charge your selected payment method for trips and services you book.
- All prices are in Nigerian Naira (₦) unless stated otherwise.
Cancellations
- You may cancel a booking through the app. A cancellation fee may apply where the driver has already accepted the trip or arrived at the pick-up location, as displayed in the app at the time of cancellation.
- Drivers may cancel where the rider cannot be located, safety is a concern, or the request breaches these Terms.
Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose, or to transport illegal or dangerous goods;
- Harass, threaten, or harm drivers, riders, or TaxiNaija staff;
- Damage a driver's vehicle or property;
- Create false accounts, spoof your location, or manipulate fares, promotions, or referral programmes;
- Reverse-engineer, scrape, or interfere with the app, website, or our systems.
We may suspend or terminate accounts that breach these Terms.
Safety
We build safety features into the Services — Smart Trip Check-In, SOS alerts, live trip sharing, and driver verification — but you use the Services at your own discretion. In an emergency, contact local emergency services first, then report the incident through the app or to contact@taxinaija.com.
Intellectual Property
The TaxiNaija name, logo, app, and website content are owned by or licensed to TaxiNaija Technologies LTD. You receive a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial use in accordance with these Terms.
Disclaimers and Limitation of Liability
- The Services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, or the availability of drivers at any given time or place.
- To the maximum extent permitted by Nigerian law, TaxiNaija's total liability to you for any claim arising from the Services shall not exceed the total fees paid by you to TaxiNaija in the six (6) months preceding the event giving rise to the claim.
- Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
Indemnity
You agree to indemnify TaxiNaija against claims, losses, and expenses arising from your breach of these Terms or misuse of the Services, to the extent permitted by law.
Termination
You may close your account at any time in the app or by contacting support. We may suspend or terminate your access for breach of these Terms, suspected fraud, or where required by law. Sections that by their nature should survive (payments owed, liability, disputes) survive termination.
Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in the app or by email before they take effect. Continued use of the Services after changes take effect constitutes acceptance.
Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Please contact support first so we can try to resolve any issue amicably. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Nigeria, without prejudice to your rights under applicable consumer protection law, including recourse to the Federal Competition and Consumer Protection Commission (FCCPC).
